Buyers in Dubai often assume that the parking bay and storage room shown during a viewing automatically belong to the apartment. That is true in most cases, but not always. Under Dubai's jointly owned property framework, a car park or storage room can be either an integral part of your apartment's title deed, or a separately registered unit with its own certificate number that can be sold, mortgaged, or rented independently of any apartment. Knowing which situation applies to a specific listing changes what you are actually paying for, and what you can do with it later.
What the law says about parking and storage attached to a unit
The starting point is Law No. 6 of 2019 Concerning Ownership of Jointly Owned Real Property in the Emirate of Dubai. Article 9 lists what a unit's components include, and it specifically names "facilities attached or allocated to the Unit, such as gardens, car parks, storage rooms, or watchmen rooms, even if such facilities are not adjacent to the unit." Their area is not counted toward the apartment's net floor area, but they remain part of the unit.
Article 10 goes further for car parks specifically. A car park allocated or designated to a unit "will be deemed an integral part of the Unit, and may not be separated, or sold independently, from that Unit." The developer must register the unit together with its designated car park in the owner's name, and "a Unit may not be sold or disposed of without the car parks designated to it." In plain terms: if a parking bay is the one officially allocated to your apartment at registration, it travels with the apartment on one title deed, whether you want to sell it separately or not.
When a parking bay or storage room becomes its own unit
The same article also opens the door to standalone parking assets. Article 10 states that an owner may purchase car parks in excess of what is allocated to the unit under applicable legislation, and that "the Director General may prescribe the cases in which Owners may purchase additional car parks." In practice, this is how many Dubai towers, especially larger mixed-use and commercial buildings, end up with surplus parking bays or storage rooms registered as their own units, each with a distinct certificate number in the jointly owned property register, separate from any specific apartment.
A separately registered bay or storage room is not tied to one apartment owner. It can be bought by an investor who owns no apartment in the building at all, sold to a different apartment owner in the same tower, or rented out on its own, since it is not protected by Article 10's "integral part" rule, which applies only to the parking allocated to a unit at the point of registration.
How to check what is actually on your title deed
Do not rely on what an agent or seller tells you a bay or storage room "comes with." Verify it directly.
- Ask for the certificate number and year printed below the barcode or QR code on the title deed, and use the DLD's Title Deed Verification service to confirm the certificate is valid and see what property type it covers, unit, land, or villa.
- Check whether the apartment's title deed description already lists an allocated car park or storage room as part of that unit, consistent with Article 9(a)(6) above. If so, it is integral and cannot be stripped off in a future sale.
- If a parking bay or storage room is being marketed as a separate purchase, ask for its own certificate number. A genuinely separate unit will have its own registration, distinct from the apartment's. If the parking or storage is integral to the unit, you cannot buy the apartment without it, and a seller cannot legally carve it out and sell it to someone else first. If it is separately deeded, the reverse is true: owning the apartment gives you no automatic claim to a nearby bay you saw during the viewing unless you also buy or lease that specific registered unit. Selling an apartment with an integral parking bay or storage room is a single transaction. Selling a separately-deeded parking or storage unit, whether alongside your apartment or on its own, is registered as its own sale with the Dubai Land Department, and the standard DLD registration fee, 4% of the sale value, paid in practice by the buyer, applies to that transaction just as it does to the apartment.
Service charges follow the register, not the marketing
Under Law No. 6 of 2019, owners pay annual service and usage charges based on the ratio of their unit's area to the total area of the jointly owned property, and an owner cannot refuse to pay charges approved by the regulator for their unit. A separately-deeded parking bay or storage room carries its own line item in the owners' association budget, distinct from the apartment's charge, even if the same person owns both. Before buying a standalone bay purely as an investment, factor in that recurring cost.
